REGULATION OF SHARIA FINANCING COMPANIES AND SHARIA FINTECH IN INDONESIA: ANALYSIS OF SHARIA FINANCING REGULATION AND SHARIA FINTECH IN THE INDONESIAN FINANCIAL SYSTEM

Abstrak

Sharia fintech in Indonesia is developing rapidly as a technology-based financial service innovation that prioritizes Sharia principles, such as fairness, transparency, and the prohibition of usury, gharar, and maysir. This development is supported by the increasing public demand for halal and inclusive digital financial services. This study aims to analyze the regulations of Sharia financing companies and Sharia fintech in Indonesia, the implementation of Sharia fintech, and the challenges faced in its development. The research method used is a qualitative method with a literature study approach through data collection from journals, books, OJK regulations, fatwas of the National Council of Indonesian Ulema Council (DSN-MUI), and various related scientific sources. The results show that Sharia fintech plays a significant role in increasing financial inclusion, especially for MSMEs and communities that have not yet reached formal financial services. Sharia fintech regulations in Indonesia are regulated by the OJK, Bank Indonesia, and the DSN-MUI, but these regulations are still general in nature and have not been fully integrated specifically according to the characteristics of Sharia finance. Furthermore, Islamic fintech also faces various challenges such as low Islamic financial literacy, limited human resources, digital security threats, and the rise of illegal fintech companies. The conclusion of this study indicates that Islamic fintech has significant potential to support the development of the Islamic economy in Indonesia, but requires strengthened regulation, supervision, and public education for optimal and sustainable development. This study recommends regulatory harmonization between the Financial Services Authority (OJK), Bank Indonesia (BI), and the National Sharia Council (DSN-MUI) and increased Islamic financial literacy to strengthen the Islamic fintech ecosystem in Indonesia.
